Training-China.com十分重视您个人信息的保密性和安全性。我们将按照本隐私政策尽合理的努力保护您的个人信息(下称“个人信息”,定义见下文)的安全。本隐私政策中使用的“我们”均指Training-China.com。
本隐私政策仅适用于我们通过Training-China.com(下称“本产品”,包含本产品内的所有内容和页面)收集的信息,不适用于我们可能通过其他方式向您收集的信息(例如,本隐私政策不适用于您可能通过电话、传真或日常信函向我们提供的信息)。
如果您不同意本隐私政策的条款,您无权访问、浏览或注册本产品。如果您选择不向我们提供本产品为您提供各种服务所必要的信息,您可能无法创建用户帐号,我们可能无法向您提供该等服务。

关于信息处理的同意
通过访问本产品或向Training-China.com提供信息,您理解并明确同意我们为本隐私政策和Training-China.com服务条款所约定的目的处理(包括收集、存储、使用、加工、传输、提供、披露和删除等)您的个人信息,包括但不限于在Training-China.com和本隐私政策所述的第三方、附属机构及分支机构之间转移您的个人数据。
我们在中华人民共和国境内运营中收集和产生的个人信息,存储在中国境内,以下情形除外:
1、适用的法律有明确规定;
2、获得您的明确授权;
针对以上情形,我们会确保依据本隐私权政策对您的个人信息提供足够的保护。
跨境信息的特殊处理规则
原则上,我们在中华人民共和国境内收集和产生的个人信息,将存储在中华人民共和国境内。由于我们可能通过境外的资源和服务器提供产品或服务,这意味着,在获得您的授权同意后,您的个人信息可能会被转移到您使用产品或服务所在国家/地区的境外管辖区,或者受到来自这些管辖区的访问。此类管辖区可能设有不同的数据保护法,甚至未设立相关法律。在此类情况下,我们会确保您的个人信息得到在中华人民共和国境内足够同等的保护。例如,我们会请求您对跨境转移个人信息的同意,或者在跨境数据转移之前实施数据去标识化等安全举措。
具体而言,如果您已注册学习Training-China.com提供的红帽技术产品和服务,您的一些个人信息可能会与红帽共享,以访问他们的学习管理系统,该系统托管在位于美国北卡罗来纳州罗利的红帽海外服务器上。要转移到海外的个人信息的范围仅限于实现处理目的所需的最小范围,其中可能包括您的名字和姓氏,就业状况、联系信息,如电子邮件、手机号码、红帽账户用户标识、学习和培训订阅信息、购买金额以及最终用户支持问题,您可能需要提高学习效率。海外共享的信息将以电子方式加密,以确保您个人信息的隐私。这些信息将只存储到您使用红帽的学习服务时。如对红帽学习管理系统使用个人信息有任何疑问,请联系王明兴先生(mwang@redhat.com).
对于除Red Hat technologies之外的任何学习产品和服务,您的个人信息将不会与海外共享,并将存储在中华人民共和国境内的服务器中并加以保护。
个人信息
个人信息是指以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息,不包括匿名化处理后的信息。本隐私政策中涉及的个人信息包括:基本信息(包括个人姓名、生日、性别、住址、个人电话号码、电子邮箱、所学专业);面部特征;网络身份标识信息(包括系统账号、IP地址、邮箱地址及与前述有关的密码、口令、口令保护答案);个人财产信息(交易和消费记录、优惠券);个人上网记录(包括网站浏览记录、点击记录)。
个人敏感信息是指一旦泄露或者非法使用,容易导致自然人的人格尊严受到侵害或者人身、财产安全受到危害的个人信息,包括生物识别、宗教信仰、特定身份、医疗健康、金融账户、行踪轨迹等信息,以及不满十四周岁未成年人的个人信息。本隐私政策中涉及的个人敏感信息包括:您的财产信息(交易和消费记录、优惠券等虚拟财产信息);面部识别特征;网络身份识别信息(包括账户名、账户昵称、邮箱地址及与前述有关的密码与密码保护问题和答案);其他信息(包括个人电话号码、手机号码、网页浏览记录)。
我们仅会出于以下目的,收集和使用您的个人信息:
(一)您须授权我们收集和使用您个人信息的情形
我们的产品与/或服务包括一些核心功能,这些功能包含了实现付费选课学习所必须的功能、观看直播所必须的功能、改进我们的产品与/或服务所必须的功能及保障交易安全所必须的功能。我们可能会收集、保存和使用下列与您有关的信息才能实现上述这些功能。如果您不提供相关信息,您将无法享受我们提供的产品与/或服务。这些功能包括:
1、实现付费选课学习所必须的功能
(1)用户注册
您首先需要注册一个Training-China.com账户成为Training-China.com用户。当您注册时,您需要至少向我们提供您准备使用的Training-China.com密码和您本人的手机号码,我们将通过发送短信验证码来验证您的身份是否有效。您的用户名称默认为注册手机号码,当您首次注册设置后仍可修改,您可以修改补充您的昵称、性别、手机号、生日以及您的实名验证相关信息,这些信息均属于您的“账户信息”。您补充的账户信息将有助于我们为您提供个性化的商品或服务推荐和更优的选课、学习体验,但如果您不提供这些补充信息,不会影响您网上选课学习的基本功能。
(2)课程与/或服务信息展示和搜索
您也可以通过搜索来精准地找到您所需要的课程或服务。我们会保留您的搜索内容以方便您重复输入或为您展示与您搜索内容相关联的课程或服务。请您注意,您的搜索关键词信息无法单独识别您的身份,不属于您的个人信息,我们有权以任何的目的对其进行使用;只有当您的搜索关键词信息与您的其他信息相互结合使用并可以识别您的身份时,则在结合使用期间,我们会将您的搜索关键词信息作为您的个人信息,与您的搜索历史记录一同按照本隐私政策对其进行处理与保护。
(3)选课下单
当您准备对您选中的课程或服务进行结算时,Training-China.com系统会生成您购买该课程商品或服务的订单。您需要在订单中至少填写您的收货人姓名、收货地址以及手机号码,同时该订单中会载明订单号、您所购买的课程商品或服务信息、您应支付的货款金额及支付方式。
上述所有信息构成您的“订单信息”,我们将使用您的订单信息来进行您的身份核验、确定交易、支付结算、完成配送、为您查询订单以及提供客服咨询与售后服务;我们还会使用您的订单信息来判断您的交易是否存在异常以保护您的交易安全。
(4)支付功能
在您下单后,您可以选择Training-China.com的关联方或与Training-China.com合作的第三方支付机构所提供的支付服务(包括支付宝、微信支付、银联等支付通道,以下简称“支付机构”)。支付功能本身并不收集您的个人信息,但我们需要将您的Training-China.com订单号与交易金额信息与这些支付机构共享以实现其确认您的支付指令并完成支付。“关联方”指一方现在或将来控制、受控制或与其处于共同控制下的任何公司、机构以及上述公司或机构的法定代表人。“控制”是指直接或间接地拥有影响所提及公司管理的能力,无论是通过所有权、有投票权的股份、合同或其他被人民法院认定的方式。
(5)交付产品或服务功能
在当您下单并在线完成支付后,Training-China.com的关联方或与Training-China.com合作的第三方配送公司(以下简称“配送公司”)将为您完成订单的交付。您知晓并同意Training-China.com的关联方或与Training-China.com合作的第三方配送公司会在上述环节内使用您的订单信息以保证您的订购的商品能够安全送达。
(6)客服与售后功能
我们的电话客服和售后功能会使用您的账号信息和订单信息。
为保证您的账号安全,我们的客服会使用您的账号信息与您核验您的身份。当您需要我们提供售前咨询或者与您订单信息相关的客服与售后服务时,我们将会查询您的访问记录或者订单信息。您有可能会在与我们的客服人员沟通时,提供给出上述信息外的其他信息,如当您要求我们变更配送地址、联系人或联系电话。

2、其他业务功能
我们其他业务功能可能会收集您的订单信息、浏览信息进行数据分析以形成用户画像,用来将您感兴趣的课程商品或服务信息展示给您;或在您搜索时向您展示您可能希望找到的课程商品或服务。我们其他业务功能还可能获取的您的其他信息,包括您与客服联系时您提供的相关信息,以及您参与问卷调查时向我们发送的问卷答复信息。我们可能会将来自某项服务的信息与来自其他服务的信息结合起来,以便为您提供服务、个性化内容和建议。
(二)您充分知晓,以下情形中,我们收集、使用个人信息无需征得您的授权同意:

(三)我们在您使用产品及服务过程中收集的信息
我们会收集关于您使用我们产品或服务以及使用方式的信息,这些信息包括:
服务日志信息:当您使用我们的网站或客户端提供的产品或服务时,我们会自动收集您对我们服务的详细使用情况,作为有关网络日志保存。包括搜索查询内容、IP地址、浏览器的类型、电信运营商、使用的语言、访问日期和时间及您访问的网页记录等。
请您理解,单独的日志信息是无法识别特定自然人身份的信息。除非将这类非个人信息与其他信息结合用于识别特定自然人身份,或者将其与个人信息结合使用,那么在结合使用期间,这类非个人信息将被视为个人信息,我们会将确保对该类个人信息做匿名化、去标识化处理(取得您的授权或法律法规另有规定的情况除外)。
当您与我们联系时,为验证您的身份,帮助您解决问题,我们可能会记录您与我们的对话并收集其他为解决问题所需的必要信息。
(四)您个人信息使用的规则
1、我们会根据本隐私政策的约定并为实现我们的产品与/或服务功能对所收集的个人信息进行使用。
2、在收集您的个人信息后,我们将通过技术手段对数据进行去标识化处理,去标识化处理的信息将无法识别主体。请您了解并同意,在此情况下我们有权使用已经去标识化的信息;并在不透露您个人信息的前提下,我们有权对用户数据库进行分析并予以商业化的利用。
3、请您注意,您在使用我们的产品与/或服务时所提供的所有个人信息,除非您删除或通过系统设置拒绝我们收集,否则将在您使用我们的产品与/或服务期间持续授权我们使用。在您注销账号时,我们将停止使用并删除您的个人信息或对您的个人信息进行匿名化处理。
4、我们会对我们的产品与/或服务使用情况进行统计,并可能会与公众或第三方共享这些统计信息,以展示我们的产品与/或服务的整体使用趋势。但这些统计信息不包含您的任何身份识别信息。
5、当我们展示您的个人信息时,我们会采用包括内容替换、匿名处理方式对您的信息进行脱敏,以保护您的信息安全。
6、当我们要将您的个人信息用于本政策未载明的其它用途时,或基于特定目的收集而来的信息用于其他目的时,会通过您主动做出勾选的形式事先征求您的同意。
披露
我们原则上不会将您的个人信息进行公开披露。
我们仅会在以下情况下,且经事先开展个人信息安全影响评估、并依评估结果采取符合业界标准的安全防护措施和去标识化处理的前提下,才会公开披露您的个人信息,并准确记录和存储个人信息的公开披露的情况,包括公开披露的日期、规模、目的、公开范围等:
1、通过您的预留邮箱,告知您公开披露的目的、披露的个人信息类型、涉及的个人敏感信息的具体内容,根据您的需求,在您明确同意的披露方式下披露您所指定的个人信息;
2、根据法律、法规的要求、强制性的行政执法或司法要求所必须提供您个人信息的情况下,我们可能会依据所要求的个人信息类型和披露方式公开披露您的个人信息。在符合法律法规的前提下,当我们收到上述披露信息的请求时,我们会要求必须出具与之相应的法律文件,如传票或调查函。我们对所有的请求都进行了慎重的审查,以确保其具备合法依据,且仅限于执法部门因特定调查目的且有合法权利获取的数据。
我们将不会公开披露个人生物识别、基因信息,不会公开披露我国公民的种族、民族、政治观点、宗教信仰等个人敏感数据的分析结果。
如果我们在披露过程中违反法律法规的规定,给您造成损失的,我们将承担因此引起的相应责任。
共享与转让:
我们不会向Training-China.com以外的任何公司、组织和个人共享、转让您的个人信息,但以下情况除外:
1、在获取明确同意或授权的情况下共享:获得您的明确同意或授权后,我们会向其他方共享、转让您的个人信息。
2、我们可能会根据法律法规规定,或按根据适用的法律法规、法律程序的要求、强制性的行政或司法要求所必须的情况对外共享、转让您的个人信息。
3、其他共享情形:与我们的关联公司和附属机构共享。
您的个人信息可能会与我们的关联公司和附属机构共享。我们只会共享必要的个人信息,且受本隐私政策中所列明目的的约束。我们的关联公司和附属机构如要改变个人信息的处理目的,将再次征求您的授权同意。
我们的关联公司包括上海学栈教育科技有限公司现在或将来控制、受控制或与其处于共同控制下的任何公司、机构以及上述公司或机构的合法继承人。其中“控制”是指直接或间接地拥有影响所提及公司管理的能力,无论是通过所有权、有投票权的股份、合同或其他被人民法院认定的方式。
我们的合伙人包括我们的技术合作伙伴公司的任何公司、机构和授权管理人员,包括但不限于安艾艾迪信息技术(上海)有限公司、重庆NIIT信息技术学校、红帽有限公司香港分公司。
收购、兼并、重组、破产
在涉及收购、兼并、重组、破产时,您理解并同意:我们可能无法满足前述“共享与转让”中列明的关于个人信息共享与转让的步骤和要求。但我们会在发布公告后的7个工作日内,通过您预留的邮箱将相关情况告知您,并要求新的持有您个人信息的公司、组织继续受本隐私政策的约束。否则,我们将要求该公司、组织重新向您征求授权同意。如果破产且无承接方的,我们将在发布公告后7个工作日内对相关数据做删除处理。
共享、转让、披露征得同意的例外
根据相关法律法规及国家标准,在以下情形中,我们可能会依法共享、转让、公开披露您的个人信息无需征得您的同意:
(1)与国家安全、国防安全直接相关的;
(2)与公共安全、公共卫生、重大公共利益等有关的;
(3)与犯罪侦查、起诉、审判和执行判决等有关的;
(4)出于维护您或其他个人的生命、财产等重大合法权益但又很难得到本人同意的;
(5)您自行向社会公开的个人信息;
(6)从合法公开披露的信息中收集您的个人信息的,如合法的新闻报道、政府信息公开等渠道;
(7)与我们履行法律法规规定的义务相关的。
(8)法律、行政法规规定的其他情形。
委托处理
目前我们并未委托任何第三方处理个人信息,如因业务发展确实需要委托的,需要满足下述条件:
1、委托行为不超出已征得您授权同意的范围。
2、我们会对委托行为进行个人信息安全影响评估,确保受委托者达到数据安全能力要求。
3、我们将确保受委托者符合以下要求:
(1)严格按照我们的要求处理个人信息,因特殊原因未按照要求的,必须及时向我们反馈;
(2)确需再次委托的,需要事先征得我们的授权;
(3)协助我们响应您提出的请求;
(4)在处理个人信息过程中无法提供足够的安全保护水平或发生了安全事件的,必须及时向我们反馈;
(5)在委托关系解除时不再存储相关个人信息。
4、我们将对受委托者进行监督,方式包括但不限于:
(1)通过合同等方式规定受委托者的责任和义务;
(2)对受委托者进行审计。
5、我们将准确记录和存储委托处理个人信息的情况。
6、若我们得知或者发现受委托者未按照委托要求处理个人信息,或未能有效履行个人信息安全保护责任的,我们将立即要求受托者停止相关行为,且采取或要求受委托者采取有效补救措施(如更改口令、回收权限、断开网络连接等)控制或消除个人信息面临的安全风险。必要时我们将终止与受委托者的业务关系,并要求受委托者及时删除从我们处获得的个人信息。
您的权利:
1、查询个人信息
您有权查询您的个人信息,法律法规规定的例外情况除外。
具体路径:
用户选择“个人中心”-“资料”里查看姓名、性别、生日、个人邮箱、地址信息。
您还可以随时通过本隐私政策载明的方式与我们联系,申请查询账号个人信息、个人信息来源、我们使用您的个人信息的目的、已经从我们处获得您的个人信息的第三方身份或类型。我们在收到您的查询邮件后,将于30个工作日内向您反馈;如我们无法提供的,将向您说明理由。
2、更正个人信息
当您发现我们处理的关于您的个人信息有错误时,您有权要求我们做出更正。您可以随时本隐私政策载明的方式与我们联系,我们将在3个工作日内进行处理;您也可以登陆您的Training-China.com账号,通过以下路径在您的账号中自行操作:
用户选择“个人中心”-“资料”里编辑姓名、性别、生日、个人邮箱、地址信息。
3、删除个人信息
在以下情形中,您可以通过本隐私政策载明的方式与我们联系,向我们提出删除个人信息的请求:
(5)法律、行政法规规定的其他情形。
如果我们违反法律法规规定或与您的约定,收集、使用您的个人信息的,我们将在收到您的前述请求后3个工作日内删除相应的信息。
如果我们违反法律法规规定或违反与您的约定向第三方共享、转让或披露您的个人信息的,我们在收到您的前述要求后,除删除相应信息外,还将立即停止共享、转让或披露的行为,并通知第三方在3个工作日内完成删除,或发布通知要求相关接收方在3个工作日内删除相应的信息,除非法律法规另有规定,或这些实体获得您的独立授权。
当您从我们的服务中删除信息后,我们可能不会立即备份系统中删除相应的信息,但会在备份更新时删除这些信息。
法律、行政法规规定的保存期限未届满,或者删除您的个人信息从技术上难以实现的,我们将停止除存储和采取必要的安全保护措施之外的处理。
4、改变您授权同意的范围或撤回您的授权
您可以通过删除信息、关闭设备功能、在Training-China.com网站或软件中进行“隐私设置”等方式改变您授权我们继续收集个人信息的范围或撤回您的授权。您也可以通过注销账户的方式,撤回我们继续收集您个人信息的全部授权。
请您理解,每个业务功能需要一些基本的个人信息才能得以完成,当您撤回同意或授权后,我们无法继续为您提供撤回同意或授权所对应的服务,也不再处理您相应的个人信息。但您撤回同意或授权的决定,不会影响此前基于您的授权而开展的个人信息处理。
5、注销账户
您可以在我们的产品中直接申请注销账户,具体路径如下:用户选择“个人中心”-“账户”-“账号注销”提交注销申请。您注销账户后,我们将停止为您提供产品与/或服务,除法律法规另有规定外,我们将删除您的个人信息。
响应
对于您基于本隐私政策提出的请求,我们将在必要的身份验证通过后进行处理,最长将在不超过三十天或法律法规规定期限内做出答复。直接实现您的请求需要付出高额成本或存在显著困难的,我们将提供其他替代方法,以保障您的合法权益。
在以下情形中,按照有关法律法规及国家标准,我们可能无法响应您的请求:
(1)与我们履行法律法规规定的义务相关的;
(2)与国家安全、国防安全有关的;
(3)与公共安全、公共卫生、重大公共利益有关的;
(4)与犯罪侦查、起诉和审判等有关的;
(5)有充分证据表明您存在主观恶意或滥用权利的;
(6)出于维护您或其他个人的生命、财产等重大合法权益但又很难得到年本人同意的;
(7)响应您的请求将导致您或其他个人、组织的合法权益受到严重损害的;
(8)涉及商业秘密的。
未成年人的个人信息保护
我们的产品、网站和服务主要面向成人。如果没有父母或监护人的同意,未成年人不应创建自己的用户账户。
我们非常重视对未成年人的个人信息的保护。如果您是未满18周岁的未成年人,在使用我们所提供的功能或服务前,应按照注册、使用流程,请您的父母或监护人仔细阅读本政策,并在得到您的父母或监护人同意后使用我们的服务或向我们提供信息并协助您完成注册流程。
如您是未成年人的监护人,当您在帮助未成年人完成注册、使用前,应当仔细阅读本政策,决定是否同意本政策并帮助未成年人进行注册、使用,以便未成年人能使用平台功能或服务。我们将根据国家相关法律法规的规定保护未成年人的个人信息。
我们只会在受到法律允许、父母或监护人明确同意、本人明确同意或者保护未成年人所必要的情况下使用或公开披露此信息。如果我们发现自己在未事先获得可证实的父母同意或本人明确同意的情况下收集了未成年人的个人信息,则会设法尽快删除相关数据。如您对未成年人个人信息相关事宜有任何意见、建议和诉求,请联系我们。我们会随时为您提供服务。
对于可能涉及的不满14周岁的儿童个人信息,我们进一步采取以下措施予以保障:
1、对于收集到的儿童的个人信息,我们除遵守本隐私政策关于用户个人信息保护的约定外,还会切实按照《儿童个人信息网络保护规定》的要求,遵循正当必要、知情同意、目的明确、安全保障、依法利用的原则。
2、我们严格遵循《网络安全法》、《中华人民共和国未成年人保护法》、《儿童个人信息网络保护规定》等法律法规的要求进行存储、使用、披露收集到的儿童个人信息,且不会超过实现收集、使用目的所必须的期限,到期后我们会对儿童个人信息进行删除或匿名化处理。
3、当您作为监护人为被监护的儿童选择Training-China.com相关服务时,我们可能需要向您收集被监护儿童的个人信息,用于向您履行相关服务之必要。在具体的服务中需要向您收集儿童个人信息的,我们会告知您收集的目的和用途,并且仅在事先取得您的授权同意的情况下收集儿童个人信息。如果您不提供前述信息,您将无法享受我们提供的相关服务。此外,您在使用注册和登录等功能时,可能会主动向我们提供儿童的个人信息,请您明确知悉并谨慎选择。您作为监护人应当正确履行监护职责,保护儿童个人信息安全。若儿童本人需要注册或使用我们的产品或服务,您应当正确引导并予以监护。
4、我们只会在受到法律允许、父母或监护人明确同意或者保护儿童所必要的情况下使用或公开披露此信息。如果我们发现自己在未事先获得可证实的父母或监护人同意的情况下收集了儿童的个人信息,则会设法尽快删除相关数据。
安全
我们非常重视个人信息安全,并采取一切合理可行的措施,保护您的个人信息:
1、数据安全技术措施
我们会采用符合业界标准的安全防护措施,包括建立合理的制度规范、安全技术来防止您的个人信息遭到未经授权的访问使用、修改,免数据的损坏或丢失。
Training-China.com的网络服务采取了传输层安全协议等加密技术,通过https等方式提供浏览服务,确保用户数据在传输过程中的安全。
Training-China.com采取加密技术对用户个人信息进行加密保存,并通过隔离技术进行隔离。
在个人信息使用时,我们会采用包括内容替换、SHA256在内多种数据脱敏技术增强个人信息在使用中安全性。
Training-China.com采用严格的数据访问权限控制和多重身份认证技术保护个人信息,避免数据被违规使用。
Training-China.com采用代码安全自动检查、数据访问日志分析技术进行个人信息安全审计。
2、Training-China.com为保护个人信息采取的其他安全措施
Training-China.com通过建立数据分类分级制度、数据安全管理规范来管理规范个人信息的存储和使用。
Training-China.com通过信息接触者保密协议、监控和审计机制来对数据进行全面安全控制。
Training-China.com建立数据安全管理组织来推进和保障个人信息安全。
我们存储您个人数据的底层云技术取得了数据中心联盟颁发的“可信云”认证。
